Judge orders Trump administration to reinstate fired Seattle U.S. attorneydeveloping

Chief U.S. District Judge Stanley Bastian ordered the Trump administration to reinstate Roger Rogoff as U.S. attorney for the Western District of Washington. Rogoff was appointed by district court judges after the post went without a Senate-confirmed nominee, and was then fired by the president. The Justice Department says it will seek an immediate stay and appeal.

The ruling saysJudge Bastian wrote that the president "cannot unilaterally fire a United States attorney appointed by the district court," and that Congress did not give the president alone the power to fill the office. Rogoff's lawyers argued the firing bypassed the Senate's role.
The Justice Department says"We disagree with the decision and intend to seek an immediate stay and will appeal." It argued the president can remove U.S. attorneys and that Rogoff's position would make court-appointed prosecutors unremovable.
